Valero Texas Open Celebration Sweepstakes

1. 1. No purchase or payment of any kind is necessary to enter for a chance to win this Sweepstakes. Void where prohibited. Need not be present to win. Sweepstakes Begins AT 8:00 AM Central time on February 7, 2012 and ends at 12:00 Am MIDNIGHT central time on April 22, 2012 (the “sweepstakes period”).
2. 2. How to enter for a chance to win: Entry into the Sweepstakes will be through completion and submission of an on-line official entry form found at valerotexasopen.org. Access to the official entry form may also be provided through a link from websites of promotional partners and/or sponsors. All portions of the official entry form marked “required field” must be filled out correctly for the entry to be accepted. Incomplete or misdirected entries, or entries received through impermissible or illegitimate channels are void. All entries must be submitted within the Sweepstakes period as defined. Golf San Antonio assumes no responsibility for lost, late, technically corrupted, stolen or misdirected entries. Access to a current, valid email account is required. Only one entry per email account will be accepted on a daily basis. All entries become property of Golf San Antonio and will not be acknowledged or returned. Golf San Antonio reserves the right to send literature to each entrant in the future. Entrant has the right to “opt-out” from receiving future communication from Golf San Antonio.
3. 3. Eligibility and General Terms: The on-line sweepstakes (the “Sweepstakes”) is open to legal residents of the Fifty (50) United States and the District of Columbia who are at least twenty-one (21) years of age. Void in Puerto Rico and anywhere outside of the U.S. Employees of Golf San Antonio (“Sweepstakes Sponsor”), Valero Energy Corporation and any co-sponsors and promotional partners, their respective companies, subsidiaries, affiliates, suppliers, advertising, promotional or judging agencies, and the families and persons living in the same household as such employees, are not eligible to participate or win. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value. Unused portions of prizes will be forfeited. Limit one prize per entrant name/email address. In the event of a dispute over the identity of an entrant, the entrant will be the registered owner of the email account. The Sweepstakes is subject to all federal, state, and local laws. Void where prohibited or restricted by law or regulations. Prize recipient will be solely responsible for paying all applicable federal, state and local taxes on prizes based on the value of the prize as set forth in these rules. No groups, clubs, newsletters or organizations may reproduce or distribute any portion of these rules to its members. All entrants, as a condition of entry, agree to be bound by these rules and the decisions of judges, which shall be final. Must be twenty-one (21) years of age or older to win.  The failure to comply with any of the rules or conditions will result in disqualification.

Prizes: Grand Prize: One (1) Winner will be selected on Friday, April 13 to receive the 2012 Ultimate Valero Texas Open Experience Prize Package; which includes: (i) five night stay at the JW Marriott San Antonio Hill Country Resort and Spa (Wed-Sun of tournament week); (ii) two (2) individual playing spots in the official Wednesday Pro-Am; (iii) two (2) individual playing spots in the Saturday Pro-Am; (iv) two (2) access credentials to the Cantina at 16 Tee hospitality venue (Thur-Sun); (v) two (2) individual spots as Honorary Observers;and (vi) two (2) invitations to 90^th Birthday Celebration events on April 21, 2012. If winner is not from Texas, prize will also include round trip coach air transportation for two(2) from anywhere in the continental United States to San Antonio, Texas. Important Note: Prize winner may request that the package be provided for the 2013 Valero Texas Open instead of 2012. In that case, prize winner acknowledges that the 90^th birthday celebration elements will be unavailable. If a winner and a guest cannot attend on the dates of the Valero Texas Open in either 2012 or 2013, the prize will be forfeited in its entirety. All travel arrangements must be made through the SPONSOR. Guest of winner must also be twenty-one years of age (21) or older. Winner and guest will be responsible for all gratuities, meals, grounds transportation and any other incidental costs or expenses not identified in these rules. No responsibility is assumed by SPONSOR(S) for canceled, delayed, suspended or rescheduled events. All prize components defined herein are awarded pursuant to a revocable, non-transferable license that is personal to the winner and guest and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated or otherwise conveyed. A violation of these restrictions shall revoke the winner’s license and items will not be honored. The approximate retail value of the Grand Prize is $20,000. All federal, state, and local taxes are the sole responsibility of the winner.

Weekly Prizes: Prizes may include: Tickets to the 2012 Valero Texas Open, Valero Texas Open merchandise, rounds of golf to a variety of San Antonio golf courses, two (2) $250 Valero Gas Cards, and many other great prizes.

1. 5. Selection of Winners: There is only one way to win: in a random drawing from all eligible entries submitted through online entry made from a current, valid email account. Random drawings for weekly prizes will be held on Mondays, beginning February 13, 2012 and ending Monday, April 22, 2012. The GRAND PRIZE winner will be selected in a random drawing from all eligible entries on or about Friday, April 13, 2012 by an independent judging organization, whose decisions shall be final. The odds of winning depend upon the number of eligible entries (registrations) received. No entrant may win more than a single drawing. All persons accompanying the Prize winner may be required to sign a Liability/Publicity Release prior to the trip. Entry constitutes permission to use the winner’s name, hometown, voice, likeness, photograph, biographical information and any statements regarding this Sweepstakes for editorial, public relations, promotional, and advertising purposes on behalf of Golf San Antonio without notice or compensation, unless prohibited by law.
2. 6. Winner Notification: Potential prize winners will be receive an EMAIL NOTIFICATION that will include an attached Affidavit of Eligibility Form to be signed by the winner and returned via email, certified mail or hand delivery within three (3) days of the notification email. The Affidavit of Eligibility Form must be received on or before the expiration of such three-day period. Failure to return the signed form within the defined period may result in disqualification effective as of 8:00 am on the day following the expiration of the return date; at which time an alternate winner may be drawn (as time permits). In the case of the GRAND PRIZE winner, guest of winner must also sign and return prize-related documents within the specified time period. Entrants who have opted not to be contacted by Golf San Antonio for any reason will be excluded from the drawing. Golf San Antonio reserves the right to substitute prizes of equal or greater value. The decisions of the Sponsor are final and binding on all matters relating to the Sweepstakes.

Limitation of Liability: Entrants and prize-winners agree to release, discharge and hold harmless Golf San Antonio, Valero Energy Corporation, co-sponsors and promotional partners, and their affiliates and agencies and their respective directors, officers, employees and agents from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Sweepstakes, the acceptance, possession, use or misuse of any prize, or travel to or from any sweepstakes related activity, and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Said parties are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, lost, late, misdirected, damaged, incomplete entries or transactions processed late, incorrectly or lost due to computer or electronic malfunction.

Important notice – Internet: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a winner based on an online account, the winning entry will be declared the “Authorized Account Holder” of the online account submitted at time of entry. “Authorized Account Holder” is defined as the natural person twenty-one (21) years of age or older who is assigned to a email account by an Internet access provider, online service provider, or the organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Use of automated devices is not valid for entry.

1. 8. Use of Data: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy in #10 below. By participating in the Sweepstakes and to the extent permitted by law, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy. Creation of an email account and use of email services are governed by their respective providers’ privacy policy.
2. 9. Name of the Winners: For the name of the winners, available after the random drawing dates stated above, send a separate, self-addressed, stamped envelope to: Golf San Antonio. Attn: Marketing Department, PO Box 690330, San Antonio, Texas 78269 and note that you are requesting a winners list. The list of winners will be available until one month after the Sweepstakes closes.

10. Privacy Policy and Disclaimer: Your privacy is very important to us. We will never rent, sell or give your email address or other contact information to anyone. Generic information from server logs may be used to track and analyze the number of hits to the site, and to find out what types of browser software are used by visitors. This information will be used only in aggregate form, and used solely for improving web site design and serving customers better.
